This privacy policy (“Privacy Policy”) explains how we collect, use, share and protect data that identifies or is associated with you (“personal data”) in relation to our website test-iq.org/business-account including the services offered on such website (the “Platform” or “Service”), and your choices about the collection and use of your information. Throughout this Privacy Policy we may refer to our website as app.test-iq.org/business-account, test-iq.org/business-account/business-account and all subdomains under test-iq.org/business-account collectively as the “Platform” or “Services”.

Brain Metrics Initiative operates a Candidate (“Candidates”) testing platform that allows Businesses and customers (“Customers”) to invite Candidates to take aptitude, personality and general skills tests through the Platform. Our Privacy Policy applies to all visitors, users, customers and others who access the Platform (“Users”).

Before accessing or using the Platform, please ensure that you have read and understood our Privacy Policy.

Definitions

• Personal Data: Any data that can directly or indirectly identify a living individual
• Candidate or Candidate: The party taking the BMI™ Assessment
• Business or Customer: The party requesting and paying for selected service from Brain Metrics Initiative (BMI™)

Our Role

If you are a customer taking an Assessment on test-iq.org/business-account or any of its subdomains, or just visiting our website, we act as the ‘data controller’ of personal data. This means we determine how and why your data are processed. For such purposes the data controller is Brain Metrics Initiative, Ltd. Themistokli Dervi, 48 Centennial Building, 4th floor Office 401 1066, Nicosia, Cyprus.

If you provide us with personal information about other people, or if others give us your information, we will only use that information for the specific reason for which it was provided to us. By submitting the information, you confirm that you have the right to authorize us to process it on your behalf in accordance with this Privacy Policy.

For the purpose of the General Data Protection Regulation (“GDPR”), depending on the type of Personal Data processing described in this Privacy Policy may be operating as a sole or joint Controller. If operating as a joint controller, both entities jointly determine the means and purposes of the processing of your personal data. What it means for you is that you can exercise your rights against either of the joint Controllers by contacting our company as set below.

Brain Metrics Initiative is the Data Controller in respect of the personal data of users of the Services, candidates, and business contacts of Brain Metrics Initiative. To the extent that Candidates’ contact details are provided by a Customer and with respect to Candidates’ Assessment reports, Brain Metrics Initiative and such Customer are deemed to be Joint Controllers for this information.

Types of Data we Collect

1. Information you provide

We collect and process some or all of the following types of information from you:

Candidates

If you are participating in an Assessment process involving Brain Metrics Initiative, you will have been in contact with another party who is our Customer (typically a potential employer, current employer or recruiter).

Brain Metrics Initiative and/or a Customer will forward a link in an email which will enable you to sign in to the Brain Metrics Initiative Assessment. When you sign in and activate your user account (“Account”) on the Brain Metrics Initiative website, you may be asked to provide or confirm certain pieces of personal information, which may include one or more of the following:

First and last name, e-mail address. You may also be asked to provide your demographic information or evaluation information for Brain Metrics Initiative itself. However, providing such information will always be voluntary and you will always be asked to give your consent before providing this type of data. You have the right to refuse to provide such data and doing so will not have any consequences on your progression through the Candidate journey, completing the Brain Metrics Initiative Assessment or your results.

In certain cases we collect a Candidate’s first name, last name and email address in relation to a Customer that is operating an initial web-based version of the service or in other cases where Candidates contact us directly with a technical support query, we may receive their name, email, and telephone number.

Customers

We collect access credentials in relation to authorized users of the Customer including title, first name, last name, email, password and Company (Business) Name and details.

• You are under no obligation to provide your personal information, with the caveat that your refusal to do so may prevent you from using certain of Brain Metrics Initiative’s features and services for which your information is required.
• If you contact Us, We may keep a record of that correspondence.
• We may also ask you to complete surveys that We use for research purposes, although you do not have to respond to them.

With regard to each Candidate who visits the Brain Metrics Initiative website or a Customer contact accessing to we may automatically collect the following information:

• Technical information, including a device identifier, the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
• Information about your visit, including the full Uniform Resource Locators (URL), clickstream to, through and from our Services (including date and time), download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number or social media handle used to connect with our customer service team.

2. Financial Information

When you are making a payment via PayPal, we collect the first name, last name and email address connected with the PayPal account. When you are making a payment via Braintree, we collect the first name, last name and 4 last digits of your credit card and its expiration date.

3. Data we collect automatically

We may automatically collect information about you when you use our website. Most of this information is collected via the use of “cookies” and other similar technologies, such as web beacons. Data relevant to your identity online and your location Your IP (Internet Protocol) address used to connect your computer to the Internet, browser type and version, browser plug-in types, time zone setting, operating system and version, timestamp signature, device type, geolocation information about where you might be and login information relevant to our website. You may choose not to share your location details with us by adjusting your location services settings.

B. Data relevant to your use of our website Your URL clickstreams (the path you take through our site), products/services viewed, page response times, download errors, how long you stay on our pages, what you do on those pages, how often, and other actions.

4. Information we collect when you use our Platform:

In some cases, you may provide personal data to us about other people (such as Candidates). You must ensure that you have given those individuals an appropriate notice that you are providing their information to us and have obtained their consent to that disclosure. Information we collect when you use our Platform:

Log file information: We collect information that your browser sends whenever you visit our Platform. This log file information may include information such as your computer’s Internet Protocol address, browser type, browser version, the pages of our Platform that you visit, the time and date of your visit, the time spent on those pages, and other statistics.

Analytics services (non-personally identifiable information only): We use third-party analytics tools to help us measure traffic and usage trends for the Platform. These tools collect information sent by your device or our Platform, including the web pages you visit, add-ons, and other information that assists us in improving the Platform. The tools use ‘cookies’, which are text files placed on your device, to collect your log information and behavior information in an anonymous form. We collect and use this analytics information with analytics information from other Users so that it cannot reasonably be used to identify any particular individual User. With respect to Google Analytics: although Google Analytics plants a permanent cookie on your web browser to identify you, the cookie can only be used by Google. Google’s ability to use and share information collected by Google Analytics about your visits is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits by disabling cookies.

DoubleClick Cookie: Google, as a third-party vendor, uses cookies to serve ads on our Platform. Google’s use of the DoubleClick cookie enables it and its partners to serve ads to our users based on their visit to our Platform or other websites on the Internet. You may opt out of the use of the DoubleClick Cookie for interest-based advertising by visiting the Google Ads Settings web page.

Remarketing: We use remarketing services to advertise on third-party websites to you after you visited our Platform. We, and our third-party vendors, use cookies to inform, optimize, and serve ads based on your past visits to our Platform.

Google: Google AdWords remarketing service is provided by Google Inc. You can opt-out of Google Analytics for Display Advertising and customize the Google Display Network ads by visiting Google Ads Settings. Google also recommends installing the Google Analytics Opt-out Browser Add-on for your web browser. This service provides visitors with the ability to prevent their data from being collected and used by Google Analytics. Pixels: We use tracking pixels from Google, Bing, Facebook, LinkedIn, and HubSpot for marketing and customer service purposes.

5. Special Category Data for Candidates

The Special Category Data we collect includes the results of the Brain Metrics Initiative Assessment, such as cognitive skills and personality traits. While overtaking the Brain Metrics Initiative Assessment we may also collect information and data related to your behavior and actions during the process of the Brain Metrics Initiative Assessment, including metadata about your real-time user interaction with the Brain Metrics Initiative Assessment. The data collected from the Brain Metrics Initiative Assessment may be subject to profiling and automated decision making.

All profiling is undertaken by suitable algorithms that act in the same way for every individual. The only information used to create profiles is the information you as a Candidate provide. We do not include information from third parties. Profiles are designed to help aid the decisions of humans, the platform does not make automatic decisions itself. Consent will be required from the candidate prior to any Assessment taking place. On completion of the Brain Metrics Initiative Assessments, reports are generated with the following information visible to the Customer: Name of candidate (unless we are requested to keep this confidential); Cognitive score and / or personality traits; A general Match Score may also be provided by Brain Metrics Initiative for single Candidates or groups of Candidates as requested by our Customer.

Should you not consent to any or all of this data being exchanged with the Customer on your behalf, said data shall not be sent. If a candidate withdraws consent to process data during an Assessment, that Assessment will be closed and no processing activities or data exchange with the Customer will occur.

We will store Assessment results for the duration of their validity (two years). If you wish to remove these test results prior to the two-year retention period, you can do so by submitting a written request via email at [email protected].

We may require you to confirm your identity prior to deleting these files, after which, all files in question will be deleted within five (5) working days.

Automated individual decision-making, including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal or similarly significant effects. How we help: The data we collect is not necessarily used in automatic decision making. In case our Customer uses automated decision making, you may require human intervention. Please contact the Customer who invited you to complete a Brain Metrics Initiative Assessment.

Information Collected by Third Parties through Third-Party Links and Content.

test-iq.org/business-account may include links to other websites and other content from third-parties which are outside our control. We are not responsible for the security, privacy of the information collected by these third parties or the privacy practices of these third parties or the content on any third-party website. We thus encourage you to review the privacy policies of those third parties.

Our Legal Basis for Processing Your Personal Data

In order to collect and/or use your personal data we have at least one of the following legal basis:

Consent

You have given us clear and explicit consent to process your personal data for one or more specific purposes. If you have previously given consent to processing your data, you can withdraw such consent at any time. You can do this by emailing us at [email protected]. If you do withdraw your consent, and if we do not have another legal basis for processing your information (for example to defend a legal claim, or because we are obliged to retain such information by law), then we will stop processing your personal data. If we do have another legal basis for processing your information, then we may continue to do so, subject to your legal rights.

Contract

Processing your data is necessary for a contract to be formulated and executed with us (for the provision of services / products or otherwise), or because such information is necessary before entering into that contract.

Existing customers

If you have been our customer in the past, we may communicate with you via email, in order to inform you about services / products similar to the ones you showed interest in, which we think you may like (read more bellow, at the section Promotional emails)

Legitimate interests

Processing your data is necessary for our legitimate interests or the legitimate interests of a third party, provided those interests are not outweighed by your rights and interests. These legitimate interests are:

• delivering, developing and improving our services and products
• determining whether marketing campaigns are effective
• improving data security
• gaining insights from your behaviour on our website in order to be able to offer you and third parties services and products which they find useful.
• Defending or exercising a legal claim.

In each case, we found that these legitimate interests were not outweighed by your rights and interests.

Processing of your data is necessary for compliance with a legal obligation to which we are subject (for example, providing you invoices).

We will only send you newsletters and promotional emails if you are an existing customer and we believe you might be interested in receiving information about our new services/products, events and offers or when you have not concluded a purchase you have initiated.

We shall only collect the email you have provided us in order to facilitate our communications and no other personal data and for no other reason.

How We Use Information

We use information about you as mentioned above and as follows:

• Specifically for Candidates: We process the contact and Assessment data that you provide us with for the purpose of providing services to our Customers. We use your information to:
• Identify you on Brain Metrics Initiative. The contact details you provide will be used to differentiate you from other participants or administrators on the system.
• Assess your skills and personality. We collect, process and store the responses you provide to the Brain Metrics Initiative Assessment.
• Produce reports. We use the responses you provide to create individual reports to give to the Customer who has requested you complete the Brain Metrics Initiative Assessment.
• Improving our products and services. Once anonymized and aggregated, we may use your responses for the purpose of refining the exercises and analysis on the reliability and validity of the tools.
• To notify users about changes to our service;
• To administer the Services under our terms and for internal operations, including troubleshooting;
• To improve our Services to ensure that content is presented in the most effective manner for Candidates and Customers;
• To allow participation in any interactive features of our Service;
• To keep our site safe and secure;
• To monitor and analyze trends and better understand how users interact with our Services, which helps us improve our Services and make them easier to use;
• To monitor and protect the security of our Services, detect and prevent fraudulent transactions and other illegal activities, fight spam, and protect the rights and property of Brain Metrics Initiative.com and others; and
• To communicate with you about offers and promotions offered by Brain Metrics Initiative.com and others we think will be of interest to you, solicit your feedback, or keep you up to date on Brain Metrics Initiative and our products.

How We Share Information

We will never sell or rent your information to third parties, or share your information with third parties for them to use for their own direct marketing purposes, unless you have requested us to do so, or we are required to do so by law, for example, by a court order for the purposes of prevention of fraud or other crime.

If you have provided personal data as a Candidate, we will share your Assessment results with the Customer who has requested you complete the Brain Metrics Initiative Assessment and with other interested Customers only subject to your previous, explicit consent. We are not responsible for how our Customers use, store or share your personal information. We advise you read their privacy policy to check you are happy with their processes.

Other instances where we share information about you in the limited circumstances spelled out below and with appropriate safeguards on your privacy:

• Subsidiaries, Employees, and Independent Contractors: We may disclose information about you to our subsidiaries, our employees, and individuals who are our independent contractors that need to know the information in order to help us provide our Services or to process the information on our behalf. We require our subsidiaries, employees, and independent contractors to follow this Privacy Policy for personal information that we share with them.
• Third Party Vendors: We may share information about you with third party vendors who need to know information about you in order to provide their services to us. This group includes vendors that help us provide our Services to you (like payment providers that process your credit and debit card information) and those that help us understand and enhance our Services (like analytics providers). We require vendors to agree to privacy commitments in order to share information with them. Location of Processing and Storage of Data

The personal data we collect is processed at our offices and servers situated in the EU and in any data processing facilities operated by the third parties identified below.
